Although we often represent Fortune 500 and international corporations throughout the country, we also have extensive experience in representing closely-held companies and individuals in the myriad litigation matters that may confront them. Our attorneys have practiced and gained experience on the bench, as judicial clerks, in U.S. Attorneys’ or District Attorneys’ offices, as Justice Department litigators, or in other government positions. In addition to our representation of private corporations and individuals throughout the country, we have represented the State of New York and other states and municipal entities in a variety matters.
Hiscock & Barclay’s attorneys appear on a daily basis throughout the country before state and federal trial and appellate courts, as well as in many other litigation forums, including various administrative tribunals. Our commercial litigators also appear routinely as arbitrators on panels sponsored by the American Arbitration Association, as mediators, and as lecturers and instructors at various symposia and educational seminars presented by federal, state and local bar associations.
A significant portion of our practice is devoted to general business litigation, including issues involving contracts, intellectual property, securities, corporate governance, ERISA, trade secrets and white-collar crime, but our practice is by no means limited to those issues, and our attorneys are well-versed in litigation involving energy and the environment, real estate, banking, tax and professional liability issues.
Negotiation, arbitration and alternative dispute resolution (ADR) often provide expeditious, economical and just alternatives to litigation. Our attorneys’ extensive trial experience enables them to assist our clients at every step of the ADR process, including in the context of arbitration and mediation, resulting whenever appropriate in the negotiation and resolution of controversies at the earliest possible juncture, including in certain instances without the need for formal litigation at all.
