Biography

Doug is Barclay Damon’s Intellectual Property Litigation Practice Area co-chair and co-leader of the Medical Devices and Communications & Networking Technology Teams. An experienced trial lawyer, he aggressively protects US manufacturers in the telecommunications and health care industries against the significant harm that results from the infringement of intellectual property rights, especially patent rights. He also defends US companies in these industries against competitor attempts to unfairly use patent litigation to hinder lawful competition.

Doug’s clients are located across the nation, and he routinely represents them in courts and administrative agencies that include the International Trademark Commission and the Patent Trial and Appeal Board in places such as Delaware, Texas, Illinois, Arizona, Arkansas, California, Minnesota, New York, Washington DC, and Wisconsin.

Doug actively works with his clients in alternative-fee arrangements to make intellectual property litigation costs more affordable and predictable.

In addition to his practice, Doug serves as the chair of Barclay Damon's AI Ad Hoc Committee.

Experience

Representative Experience

  • Served as lead trial counsel and won a complete jury verdict of willful infringement of multiple patents and a $61 million enhanced-damages award for the plaintiff, the patent owner and industry leader in coaxial-cable connectors, against its leading competitor (PPC Broadband, Inc. v. Corning Optical Communications RF, Inc. – (NDNY)).
  • Served as lead US trial counsel in a multinational patent-infringement dispute concerning an invention related to polymer chemistry in medical devices.
  • Represented a leading US manufacturing company in connection with the domestic and foreign enforcement of its extensive patent portfolio.
  • Defended a Global 500 company against patent-infringement claims brought in the Eastern District of Texas concerning processes used to manufacture pharmaceuticals.
  • Defended a leading medical-products company against patent-infringement claims brought in the Southern District of New York concerning a modified otoscope design.
  • Defended a manufacturing company against patent-infringement claims brought in the Central District of California concerning metal alloys used in the manufacture of DVDs.
  • Represented a telecommunications company in enforcing patent and trade-dress rights against a competitor in litigation brought in the District of Minnesota.
  • Defended a manufacturer of HID lamps and obtained dismissal of patent-infringement claims brought in the Southern District of Ohio.
  • Represented a munitions manufacturer in an appeal before the US Court of Appeals for the Federal Circuit in connection with the enforcement of some of its patents against a competitor.
  • Secured the dismissal of a patent infringement case commenced against a global manufacturer of telecommunication products without having to make a monetary payment.
